DERBY – A 48-year-old man racked up multiple charges after police responded to an apartment building located on Lynwood Drive in Derby last Friday. Authorities are reporting that at one point the man spit at an Orleans County Sheriff’s deputy.

Police say that Scott Auck was arrested and charged with disorderly conduct, disturbing the peace by use of telephone, assault on a law enforcement officer with bodily fluids, and resisting arrest, after they were called out to the building at around 7:30 p.m. for a report that he was intoxicated, yelling vulgar language and demanding to enter an apartment.

Police say that this was the fourth response from law enforcement regarding Auck in as many days.

Upon arrival, Auck became more belligerent. He was advised that he was under arrest when he began to resist attempts to handcuff him. At one point police say he spit at an Orleans County deputy and kicked his feet at a trooper.

He was ultimately taken to the Derby Barracks where he was processed for the charges.

Auck was held at Northern State Correctional Facility for lack of the ability to be released to a responsible adult.
