PENN YAN — A 38-year-old Penn Yan man was arrested for felony driving while intoxicated following a two-car accident at a local business, police said.
Shawn M. Madigan was taken into custody on April 17 after officers responded to reports of a collision.
Witnesses identified Madigan’s vehicle as the one that caused the accident, according to the Penn Yan Police Department.
Officers observed several indicators of impairment when they contacted Madigan at the scene.
Madigan failed standardized field sobriety tests administered by police.
Following his arrest, Madigan was transported to Soldiers and Sailors Hospital where he voluntarily submitted to a blood draw.
A Department of Motor Vehicles check revealed Madigan had a previous DWI conviction within the past ten years, elevating the current charge to a felony.
Madigan was processed and released on a traffic ticket with orders to appear in Penn Yan Village Court at a later date.
Additional charges are pending the results of the blood analysis, police said.
