Bronx man faces felony DWI charges after Mamaroneck traffic stop

MAMARONECK — A Bronx man faces multiple felony charges after state police found him allegedly driving drunk with a 1-year-old child in his vehicle during an early morning traffic stop on Interstate 95.

Marvin X. Gallardo, 33, was stopped at approximately 1:58 a.m. Monday for multiple traffic violations while driving a 2018 Mercedes-Benz southbound in the Village of Mamaroneck.

Troopers from the New Rochelle barracks observed signs of intoxication during the interview with Gallardo, according to police.

After failing standardized field sobriety tests, Gallardo was taken into custody and transported to the State Police New Rochelle station for processing.

Police said Gallardo consented to a breath test that yielded a 0.14% blood alcohol content, nearly twice the legal limit.

Investigators determined Gallardo had a prior DWI conviction from 2017, elevating the current charges to felonies.

Gallardo faces charges including Aggravated Driving While Intoxicated with a Child Passenger under Leandra’s Law, an E felony, and two additional E felony counts related to driving while intoxicated with a prior conviction.

He was also cited for multiple vehicle and traffic violations.

Gallardo was issued an appearance ticket and is scheduled to appear in Mamaroneck Village Court on May 15.
