GENESEO — Sheriff Thomas J. Dougherty reports the arrest of a Leicester man on felony charges following a motor vehicle crash.
On March 20 at approximately 6:20 p.m., Livingston County Sheriff’s Deputies responded to the area of Lakeville Groveland Road in the Town of Geneseo for the report of a vehicle in a ditch.
While responding, Deputies were further advised that two occupants of the vehicle were leaving the scene on foot.
Upon arrival, Deputies were able to locate the occupants in the area.
The operator of the vehicle was identified as 24-year-old Marc Cruz.
The investigation of the scene determined that the vehicle was traveling southbound on Lakeville Groveland Road when it left the roadway striking a ditch.
It is further alleged that Cruz attempted to conceal beer cans and liquor bottles following the crash.
Deputies suspected that Cruz was under the influence of alcohol and attempted to conduct a Driving While Intoxicated investigation, which included the performance of standardized field sobriety tests.
Cruz refused to perform the field sobriety tests and was taken into custody for DWI.
A check of his criminal history showed Cruz had a prior DWI conviction in 2022, making this DWI a felony.
Cruz was arrested and charged with felony Driving While Intoxicated, felony Tampering With Physical Evidence and violations of the NYS Vehicle and Traffic Law.
Cruz was transported and turned over to Central Booking Deputies at the Livingston County Jail for arrest processing, and pre-arraignment detention.
Cruz was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of Mount Morris Justice Ossont.
The Judge released Cruz on his own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.
