Barton board reviews dog-attack complaint after owner fails to appear

Board members Dee McDowell and Ryan Racine ask David White of Barton, the owner of the dog that was attacked, clarifying questions about the dog incident before telling white that he will receive their decision within thirty days.

BARTON –– A Barton resident failed to appear before the selectboard during a public hearing, to respond to a complaint that his dog attacked a neighbor’s dog. The board heard evidence and testimony about the incident as an agenda item at Monday’s regular meeting.

Dave White, the neighbor, described the attack on his dog, Braxton, by Ken Bacon Jr.’s dog on December 30, 2024. White provided video surveillance footage of the attack, which showed White intervening to stop the fight. White also described how the attacking dog aggressively pursued him as he brought Braxton into his house.

Braxton sustained injuries in the attack and was taken to an emergency veterinarian in Littleton, NH, due to swelling and a fever. White provided testimony about Braxton’s inability to stand and the subsequent fever that prompted the emergency visit.

Misty Johnson, who lives with White, also offered testimony, stating that she witnessed Bacon’s dogs pinning Braxton down. Johnson relayed the veterinarian’s concern that Braxton’s high fever could have caused brain damage if treatment had been delayed.

The testimonies provided to members of the selectboard indicate a pressing need for action to ensure public safety and accountability. Ryan Racine, selectboard chair, asked White if he had ever known of this particular dog to be aggressive toward people. White then referenced the video and stated that Bacon’s dog could be seen charging him at the entrance of the house.

At the close of the hearing, Racine said the board will take all evidence and testimony into consideration.

“Nothing ever happens as quickly as we hope. We will get our decision out to you within thirty days,” said Racine.

The board’s decision will be crucial in determining the next steps regarding the complaint against Bacon and his dogs.
