NEWTON — A Framingham man was arraigned Thursday on charges related to a non-fatal shooting that occurred during a demonstration in Newton on Wednesday evening.
Scott Hayes, 47, appeared in Newton District Court on charges of assault and battery with a dangerous weapon.
The court set bail at $50,000 with a $5,000 cash option and imposed conditions including home confinement between 7 p.m. and 6 a.m., staying away from Newton and the victim, and not possessing dangerous weapons.
According to Middlesex District Attorney Marian Ryan and Acting Newton Police Chief George McMains, the incident occurred around 6:40 p.m. Wednesday near Harvard and Washington streets.
Hayes was reportedly demonstrating with a small group when a verbal altercation began with a 31-year-old Newton man.
The Newton man allegedly tackled Hayes, leading to a physical altercation during which Hayes shot the man.
The victim, whose name has not been released, was transported to a local hospital and is expected to survive.
Newton police have applied for a criminal complaint for assault and battery against the 31-year-old Newton man.
As the alleged assault did not occur in the presence of officers, a summons will be issued for a hearing before a clerk magistrate.
Hayes’ license to carry has been suspended.
His next court date is set for Nov. 7.
The investigation, conducted by Newton Police, the Middlesex District Attorney’s Office, and Massachusetts State Police detectives, is ongoing.
Authorities continue to review video footage and interview witnesses.
